These Terms and Conditions (“Terms”) govern your (“User”) use of the Soetwater Supply Co. (“Provider”) website located at www.soetwatersupplyco.co.za (“Website”). By accessing and using the Website, the User agrees to be bound by these Terms. The User may not access, display, use, download, copy, or distribute content obtained on the Website for marketing or other purposes without the prior written consent of the Provider.
1. Electronic Communications
By using this Website or communicating with the Provider by electronic means, the User consents and acknowledges that all agreements, notices, disclosures, and other communications satisfy any legal requirement, including (but not limited to) the requirement that such communications be in writing.
2. E-Commerce & Privacy
The Website is an online marketplace where customers can purchase products offered by Soetwater Supply Co. Customers select products, choose a logistics option where applicable, and make payment as per the payment procedure below.
- The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/User indemnifies and holds the Provider harmless against any loss, injury, or damage sustained as a result of using products sold on the Website.
- The private information required for executing orders—such as personal details, contact numbers, and delivery addresses—will be kept in the strictest confidence by the Provider and will not be sold or disclosed to third parties, except to the extent necessary to fulfil delivery (e.g., courier requires delivery address and contact number).
- The Provider does not store credit card details.
- The Provider is not responsible for security breaches occurring on the User’s device (e.g., due to malware, spyware, or inadequate security software).
3. Cookies
The Website uses cookies to enhance user experience and improve functionality. Cookies help us understand browsing behaviour and preferences. Users may disable cookies in their browser settings, but doing so may affect the Website’s performance and certain features. No personally identifiable information is stored in cookies.
4. Payment Procedure
All payments are to be made via EFT, credit card, or bank deposit, unless otherwise agreed in writing or made in-store.
- A formal invoice or pro forma invoice will be issued to the User.
- Proof of payment must be emailed to info@soetwatersupplyco.co.za when paying via EFT or deposit.
- Orders are released/dispatched only once payment has cleared into the Provider’s account.
- No bank account details are published on this Website; payment instructions are provided on the invoice.
Credit Card Acquiring & Payment Gateway:
Credit card transactions are acquired by PayFast (Pty) Ltd, a registered system operator and payment gateway in South Africa. Cardholders may visit www.mygate.co.za to view PayFast’s security policy.
5. Acceptance of Orders
- Orders placed through the Website are confirmed by email after submission; no order is deemed accepted until such confirmation has been issued.
- All orders are fulfilled subject to these Terms.
- Certain products may be unavailable for delivery to specific regions or countries.
- Quotations are valid for 10 (ten) days from date of issue unless stated otherwise.
6. Currency and Pricing
- Prices are quoted in South African Rand (ZAR) by default.
- Prices are subject to change without notice and subject to stock availability and manufacturing lead times where applicable.
7. VAT
- VAT is included and charged on all invoices, unless expressly stated.
- Purchases by clients outside the Republic of South Africa will be VAT-exempt only if valid proof of export and customs documentation is provided.
8. Payment & Shipping
- Goods remain the property of the Provider until paid for in full.
- Shipping options and costs are quoted after an order is placed or as part of a written quotation. Delivery may not be available door-to-door in certain areas.
- From the moment goods are dispatched, risk passes to the customer/User. Users are encouraged to purchase transit insurance if desired.
- In the unlikely event that a logistics provider loses or damages an order, the Provider will assist the User in liaising with the carrier; however, the Provider is not liable for the behaviour, delays, or actions of any third-party courier or logistics provider.
- The Provider works with reputable courier partners selected for their service coverage and reliability. Border posts, customs, and excise processes are outside the Provider’s control.
9. Refunds & Returns
- Returns are accepted only if the order is incorrectly supplied, and then on an exchange-only basis, provided the product is unused, undamaged, and in its original packaging.
- If a User believes a product to be faulty, the item must be returned at the User’s cost for assessment under the relevant supplier/manufacturer terms for repair or replacement, where applicable.
- The User is responsible for all courier costs associated with returns and exchanges.
- Made-to-order or customised items (including branded, embroidered, or bespoke hospitality products) are non-refundable once production has started, except where goods are defective or incorrectly supplied.
- The Provider accepts no responsibility for loss or damage once goods have been dispatched.
10. Updating of These Terms
The Provider reserves the right to change, modify, add to, or remove portions of these Terms at any time. Changes become effective when posted on the Website. It is the User’s responsibility to periodically check the Website for updates. Continued use of the Website following changes constitutes acceptance of the updated Terms.
11. Copyright & Intellectual Property
All content displayed or to be displayed on the Website—including text, images, artworks, product data, graphics, and software (“Content”)—is owned by the Provider or its licensors and is protected by South African and international copyright laws.
- The Provider may change the Website, its Content, and/or products and services offered at any time without notice.
- Except as expressly permitted in these Terms, no license is granted to the User under any intellectual property rights. All rights are reserved.
12. Limitation of Liability
The Website and all Content are provided on an “as is” basis and may include inaccuracies or typographical errors. The Provider makes no warranties or representations regarding availability, accuracy, or completeness. To the fullest extent permitted by law, the Provider (and its affiliates) shall not be liable for any direct, indirect, special, or consequential damages arising from the use of, or inability to use, the Website or any linked site—even if advised of the possibility of such damages.
13. Privacy: Casual Surfing
Users may browse the Website without submitting personal information. The Website servers may collect the User’s IP address to measure usage statistics (e.g., number of visits, average time on site, pages viewed). The Provider assumes no obligation to protect such aggregated, non-identifying information and may use it without limitation.
14. Choice of Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. The User consents to the jurisdiction of the High Court of South Africa (or any court of competent jurisdiction) for any dispute arising from these Terms or the use of the Website. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remainder will continue in full force and effect. These Terms constitute the entire agreement between the Provider and the User regarding the Website and its Content.
